Don’s practice is primarily commercial litigation and arbitration including sale of goods, commercial agency, construction, engineering and motor industry cases. He also appears in professional negligence cases, partnership and LLP actions, and trust litigation.

He is client friendly and known for his ability to assimilate a complex brief and respond rapidly with tactics and strategy, including pre-emptive remedies when required.

He is an experienced mediation advocate and is a mediator with the ADR Group. He conducts Public Access cases.

  • Cases of interest

    Curran v Collins [2015] EWCA Civ 404. For successful Respondent, at first instance and in Court of Appeal, resisting claim in constructive trust to half share in house and business by ex-cohabitee. Don’s article about this case is at [2015] Family Law (Sept) p 1079

    Secretary of State vs Carlson: 2014 Contested director’s disqualification application in Companies Court; appeal and section 17 application.

    Re Sportz Academy Ltd in liquidation: Steven White (2014)  resisting £1.3m claim on (contested) basis that defendant was a shadow director.

    Pressfab v Chargemaster TCC. Claim for £305,000 unpaid goods (electric charging posts for cars); counterclaim £500,000 that posts were of defective quality.

    Ghanem Al-Thani Holdings WLL vs Jaguar Cars Exports Ltd [2012] EWHC 856 (Comm). Defending claim by Qatari Sheikh for £7m for alleged misrepresentation and breach of contract.

    FCL (London) Ltd v Voice [2013] All ER (D) 09 (Jan) . Claim for £585,000 accountancy fees.

    AA vs G LCIA Arbitration 2012 Claim for $3m unpaid fees for work on development site in Moscow.

    X vs Y 2011 LCIA Arbitration: Claim for €18 million dividend arbitrage profits lost by reason of D wrongfully suspending C from LLP.

    Starglade Properties Ltd v Nash [2010] EWCA Civ 1314 Re scope of dishonest assistance in breach of trust. Judgment at first instance reversed by Court of Appeal.
